1. Acceptance of Terms
By downloading, installing, or using the 1RS Meal application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App after such modifications constitutes acceptance of the updated Terms.
2. Description of Services
1RS Meal is a food discovery and delivery platform that connects users with local restaurants and food vendors ("Partners"). We facilitate the ordering, payment, and delivery of food items. We act as an intermediary between you and the Partners and are not responsible for the preparation, quality, or safety of the food items provided by Partners.
3. Eligibility
You must be at least 18 years of age to create an account and use our services. By using the App, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements. If you are using the App on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.
4. Account Registration & Security
You are required to register an account using your mobile phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must immediately notify us of any unauthorized use of your account or any other breach of security. We shall not be liable for any loss arising from unauthorized use of your account.
5. Orders, Payments & Pricing
All prices displayed on the App are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice. Once an order is placed and confirmed, it constitutes a binding agreement to pay the order amount. Payments are processed through third-party payment gateways (including Razorpay). We do not store your complete payment card details. Refunds, if applicable, will be processed in accordance with our refund policy and credited to your original payment method or wallet within 5-7 business days.
6. Order Cancellation & Refunds
You may cancel an order before it has been accepted by the Partner. Once an order has been accepted and preparation has begun, cancellation may not be possible. In such cases, a partial or no refund may be issued at our sole discretion. If you receive an incorrect, incomplete, or unsatisfactory order, please contact our support team within 24 hours of delivery. Refund eligibility will be determined on a case-by-case basis. We reserve the right to deny refund requests that we believe are fraudulent or abusive.
7. Delivery
Estimated delivery times displayed on the App are approximate and may vary based on factors such as order volume, weather conditions, traffic, and Partner preparation time. We are not liable for delays in delivery caused by circumstances beyond our reasonable control. You are responsible for providing an accurate delivery address and being available to receive the order. Additional delivery charges may apply based on distance and order value.
8. Rewards & Loyalty Program
1RS Meal may offer loyalty rewards, cashback, referral bonuses, and promotional credits ("Rewards"). Rewards are subject to separate program-specific terms, expiry periods, and fair usage policies. We reserve the right to modify, suspend, or terminate any Rewards program at any time without prior notice. Rewards have no cash value and cannot be transferred, exchanged, or redeemed for cash. Abuse or manipulation of the Rewards program may result in forfeiture of accumulated Rewards and account suspension.
9. Acceptable Use
You agree not to: (a) use the App for any unlawful purpose or in violation of any applicable law; (b) impersonate any person or entity or misrepresent your affiliation; (c) interfere with or disrupt the App or servers connected to the App; (d) attempt to gain unauthorized access to any part of the App; (e) use any automated means to access the App including bots, scrapers, or crawlers; (f) upload or transmit any content that is harmful, offensive, defamatory, obscene, or infringes on intellectual property rights; (g) place fraudulent orders or engage in any activity that manipulates promotions, pricing, or Rewards.
10. Intellectual Property
All content on the App, including but not limited to text, graphics, logos, icons, images, audio, video, software, and the compilation thereof, is the property of 1RS Meal or its licensors and is protected by Indian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the App without our prior written consent.
11. Third-Party Services
The App may contain links to or integrations with third-party services, including payment processors, delivery providers, and mapping services. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of any third-party service and do not endorse them. Your use of such services is at your own risk.
12. Disclaimer of Warranties
The App and its services are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no representations about the quality, safety, or legality of food items offered by Partners.
13. Limitation of Liability
To the maximum extent permitted by applicable law, 1RS Meal, its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the App. Our total aggregate liability for any claim shall not exceed the amount paid by you to us in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless 1RS Meal, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
15. Termination
We may suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. You may terminate your account at any time by using the account deletion feature in the App or by contacting our support team. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall remain in effect, including ownership, warranty disclaimers, indemnity, and limitations of liability.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India. Before initiating any legal proceedings, you agree to attempt to resolve any dispute through good-faith negotiation and, if necessary, through mediation.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
